Zero Driver Terms and Conditions

Welcome to Zero Driver Limited (“Company,” “we,” “us,” or “our”). This website, www.zerodriver.co.nz, is owned and operated by Zero Driver Limited.
These Terms and Conditions (“Terms”) govern your use of our services, including booking a driver to transport you and your vehicle to your designated destination. By hiring our services (in person, over the phone, or online), you (“Customer,” “you,” or “your”) agree to these Terms.
We are committed to excellent customer service, safety, and satisfaction. All drivers follow a strict code of conduct to ensure you and your vehicle arrive safely. If you have any concerns or feedback about your experience, please contact us.
1. Services Provided
Zero Driver Limited provides a Dial a Driver service within the Auckland region, connecting customers with experienced drivers to safely transport them in their own vehicles.
2. Driver Qualifications and Responsibilities
All drivers:
- Are over 25 years of age and hold a full New Zealand driver’s license with a Passenger Endorsement (P endorsement).
- Comply with all relevant New Zealand transport regulations.
Drivers reserve the right to refuse service if:
- The customer appears intoxicated beyond a safe level.
- The vehicle is unsafe or excessively dirty.
- The driver feels threatened, unsafe, or abused by the behavior of the customer or passengers.
3. Customer Responsibilities
- Vehicle Condition: Customers must ensure their vehicle is clean and roadworthy, with a current Warrant of Fitness (WOF) and registration.
- Insurance: Customers are required to maintain comprehensive insurance for their vehicle. Zero Driver Limited is not liable for any fines or damages due to vehicle defects.
- Conduct: Smoking in the vehicle while the driver is present is prohibited, and respectful conduct toward drivers is expected at all times.
4. Service Area
Zero Driver Limited operates primarily within the Auckland region. Bookings outside of Auckland may require advance notice and incur additional charges.
5. Fees and Pricing
- Base Fare: A rate of $3.50 per KM applies.
- Flat Fee: An additional $40.00 flat fee is applied per ride for administrative costs and driver dispatch.
Additional Charges:
- Waiting Time: 5 minutes of free waiting time; $1 per minute thereafter.
- Distance Surcharge: $1.50 per KM for pickup locations over 25 KM from Auckland CBD.
- No-Show Fee: A $60 charge for last-minute cancellations or no-shows.
- Peak Hours Surcharge: A 15% surcharge applies during peak hours (4-6 PM weekdays), Christmas Day, and New Year’s Eve.
- Cleaning Fee: A $150 soiling fee may apply if cleaning is required.
Payment Methods: We accept EFTPOS, Visa, Mastercard, AMEX, and cash (rounded to the nearest $5). Corporate accounts are available upon request.
Price Surge: A price surge may apply during high-demand periods to maintain service levels. The rate increase will vary but is capped between 25% and 100% of the total cost.
6. Cancellation and Refund Policy
- Cancellations: Bookings can be canceled at any time; however, fees may apply based on the notice period.
- Refunds: Refunds are processed via the original payment method and may take up to 5-10 business days.
7. Liability in Case of Accident or Damage
- Customer’s Insurance: Your vehicle’s insurance policy will be the primary coverage for any damage resulting from an accident while the driver operates your vehicle.
- Driver’s Liability: Drivers are responsible for any excess fees in the case of at-fault accidents.
- Zero Driver Limited Liability: Zero Driver Limited is not liable for any damages or costs arising from accidents.
8. Procedure in Case of Accident or Injury
In the event of an accident or injury, customers must report it to Zero Driver Limited within 24 hours.
9. Privacy Policy
We collect personal information (e.g., name, contact details) to deliver services and provide quotes. Payment information is not stored; all transactions are processed securely by third-party providers.
Sharing of Information: Personal information may be shared with:
- Driver partners for service delivery.
- Law enforcement if required.
- Debt collection agencies in cases of unpaid invoices.

10. Compliance
Zero Driver Limited is fully licensed, and all drivers comply with New Zealand transport regulations.
11. Dispute Resolution
Any disputes arising from these Terms will be resolved through good faith negotiations. If unresolved, New Zealand law governs, and disputes will be submitted to New Zealand courts.
12. Changes to Terms
Zero Driver Limited reserves the right to update these Terms at any time. Customers will be notified of changes on this page. We recommend reviewing these Terms periodically.

14. Entire Agreement
These Terms constitute the entire agreement between you and Zero Driver Limited regarding the use of our services.

If any provision is found to be unenforceable, the remaining provisions will continue in full effect.
16. Waiver
No waiver of any breach shall be deemed a waiver of any subsequent breach.
